In such an event, the court may appoint a person deemed competent by the court. A full home study must then be made to determine the ability of the applicant to meet the needs of children available for adoption, and the specific characteristics of children the applicant indicates would be most suitably placed in the home. The court may enter a decree of adoption if it is satisfied that the petitioners are fit and proper persons and financially able to give the individual a proper home and education and that the adoption will be for the best interests of the child. A request may be made at that time to change the child’s name to whatever name the adoptive parents have chosen. Finalization of the adoption can occur no sooner than 90 days following placement, so the process of finalizing an adoption is one which will take several months. Even if 90 days has elapsed, an adoption still cannot be finalized unless all legal prerequisites such as completion of post-placement supervision have been met.
A report of a preplacement investigation that has approved a prospective adoption petitioner for a placement shall not authorize placement of a minor person with that petitioner after 1 year from the date of the report’s issuance. This includes foster parents who want to be considered as adoptive parents for a child who has a plan of adoption. These requirements include compliance with the Indian Child Welfare Act, the Multi-Ethnic Placement Act of 1994, and the Interethnic Adoption Provisions of 1996.
Whenever a foster child is freed for adoption, the agency shall notify the foster parents in writing. Placement in legal risk adoptive homes is made in an effort to facilitate permanent placement for children whose permanency planning goal is adoption. Before an adoptive home may be approved, an applicant and all household members age 18 and older shall apply for a criminal background investigation. In addition, the applicant and all household members age 18 and older shall consent to a child protective services clearance to determine if there is a prior indicated or unsubstantiated finding of abuse or neglect for any family or household member. Prior to sending a child to another State for placement, the public child-placing agency in the sending State shall provide a written request for assessment to the receiving State. Upon receipt of a request from the public child welfare agency of the sending State, the receiving State shall initiate an assessment of the proposed placement to determine its safety and suitability.
The adoptive parent is in the military service of the United States or is employed by the American Red Cross and completion of the 6-month supervisory period would delay completion of an adoption that the agency has determined should be completed. The prospective adoptive parent is the child’s adult sibling, by whole or half blood, or the child’s aunt, uncle, grandparent, or great-grandparent, and the child has resided with the prospective adoptive parent for at least 1 year. During the postplacement period, the agency shall document any changes in the adoptive family in health, financial condition, or composition that may affect the child.

The term ‘home study’ means an assessment of the safety and suitability of placing the child in the home of the prospective adoptive parent based on an evaluation of a home environment.
